Based on the Governor’s guidance for restaurants effective May 27, 2020, restaurants will be able to open for in-person dining at 50-percent capacity of the indoor posted occupancy code limit, but cannot exceed 50 people, whichever is less. The City of Brighton is dedicated to working with restaurants in order to maximize the number of patrons possible at each establishment. As such, City staff is providing the following guidelines for those looking to temporarily expand operations safely and timely into adjacent areas including parking lots.
Guidance on Expansion into Parking Lots or Adjacent Areas:
Businesses requesting to expand operations must apply for a Temporary Use Permit. The permit application must be submitted to the City’s Building Division and once approved, will be valid for 90 days. To ensure safe and functional operations and to ensure an expedited turnaround of the permit, the application will need to include a drawing (i.e., site plan) that notes the items below:
If an outdoor tent is to be proposed, the Building Division will provide the applicant with a separate addendum for the Fire District that requests specific information on the tent structure and placement.
If the expansion is to occur into a parking area, please provide the total number of existing parking spaces and the total number to be used for the business expansion. If the business is proposing to use a parking area that is not owned by the business, a letter from the property owner must be submitted with the permit to show that the property owner has approved the use of their property for the business expansion.
Please include the square footage to be used in the proposed outdoor expansion area.
Please include information on any added lighting for safety purposes, vehicle barriers to separate the area from traffic and remaining parking, and any further information on how the area will be marked off.
If the expansion includes a proposal for any electrical work, this may be included on the permit with needed design (one-line) diagrams for any installations.
All sidewalks must have a minimum of four feet in width of passable space. No blocking of ADA ramps or parking spaces will be allowed.
If the outdoor area is proposed to be used for alcohol sales, service, or consumption of any nature, please refer to the following section of this guidance document.
If the outdoor area is not to be proposed for the use of alcohol sales, service, or consumption, the area must be properly marked that no alcohol is to be in the area if it is in use elsewhere on the premises.
Expansion onto any public sidewalk or right-of-way will be evaluated on a case-by-case basis.

Updates on Liquor Regulations:
Below are updates on actions the City Clerk’s Office and the Liquor Licensing Authority are currently conducting to help our local businesses regarding liquor regulations in this difficult time.
The City Clerk’s Office is currently approving all applications administratively.
Any liquor license holder has the option to apply for a temporary modification of premises OR a permanent modification of premises. As with all liquor license applications, there is a dual approval process with the City of Brighton’s Liquor Licensing Authority and the State of Colorado’s Liquor Enforcement Division. Alcohol cannot be sold, served or consumed outside of the currently licensed/permitted area until approved by the State and City.
The Police Department is currently unable to offer the State of Colorado’s required Liquor Seller/Server training class due to facility closures. As previously noted, the City Clerk’s Office is approving all applications administratively without the required training certificates on file so that the application can move quickly to the State of Colorado’s Liquor Enforcement Division for approval. Please note that each business in this situation has been advised that the required Liquor Seller/Server training must be completed within 60 days of the business reopening.
The City of Brighton Liquor Enforcement Officer, Gail Ashley, has been approving all inspections administratively without physically performing an actual inspection of the premises due to business closures. Please note that each liquor license has been noted so that Officer Gail Ashley can complete the physical inspections within 60 days of the business reopening to ensure all businesses are in compliance.
